(English Below)

Tax Compliance

What You Should Know: New e-Withholding Tax Law, Only 1% Withholding Until the End of 2027

Good news for businesses and income earners. The law extending the reduced 1% withholding tax (WHT) rate for payments made through the e-Withholding Tax (e-WHT) system has been published in the Royal Gazette. Prom Legal Solution summarises the key points below.

1. The New Law and Key Points

  •     The Cabinet approved the extension on 16 June 2026.
  •     Ministerial Regulation No. 402 (B.E. 2569), issued under the Revenue Code and published in the Royal Gazette in October 2026. It continues the earlier measure under Ministerial Regulation No. 389 (B.E. 2566), which expired on 31 December 2025.
  •     The standard WHT rates of 5%, 3% and 2% are reduced to 1% when payment is made through the e-WHT system.
  •     It applies to income paid from 1 January 2026 to 31 December 2027, with retroactive effect to the start of 2026.
  •     A companion measure, Royal Decree No. 808 (B.E. 2569), lets companies and juristic partnerships deduct 200% of their investment and service costs for e-Tax Invoice & e-Receipt and e-WHT systems over the same period.

2. Eligible Income Types and Main Conditions

Income types eligible for the 1% rate (following the scope used since Ministerial Regulation No. 389):

  •     Property rental, such as buildings or land, excluding boat rental (normally 5%)
  •     Liberal professional fees, such as legal, accounting, engineering and architecture (normally 3%)
  •     Contract work and hire-of-work payments (normally 3%)
  •     Service fees and commissions, plus goodwill, copyright and other rights paid to juristic persons (normally 3%)
  •     Advertising fees (normally 2%)
  •     Prizes from contests, competitions or lucky draws, and fees paid to Thai-resident public entertainers (normally 5%)
  •     Prizes, discounts or benefits from sales promotions (normally 3%)

Main conditions:

  •     Payment and tax remittance must go through the e-WHT system of a participating bank (under Section 3 Pannarasa of the Revenue Code). Payments by cash, cheque or ordinary bank transfer remain subject to the standard rates.
  •     The payee must be an individual, a company or a juristic partnership. Foundations and associations are excluded.
  •     Payment must be made between 1 January 2026 and 31 December 2027.

3. Transactions Affected

The measure covers domestic B2B payments and payments to individuals, such as freelancers and outsourcing, rent for offices, warehouses or retail space, consultants, and advertising agencies or influencers.

Transactions outside the measure:

  •     Employee salaries and wages under Section 40(1)
  •     Income paid abroad under Section 70
  •     Dividends and interest, which follow separate rules
  •     Transport fees, which are already subject to 1% WHT

4. Impact and Benefits for Individuals

  •     More cash up front. A freelancer billing THB 100,000 has THB 1,000 withheld instead of THB 3,000, so they receive THB 2,000 more immediately.
  •     A landlord receiving THB 50,000 in rent has THB 500 withheld instead of THB 2,500.
  •     No need to wait for a paper 50 Tawi certificate, because withholding records can be checked on the Revenue Department’s website.
  •     Less over-withholding means smaller year-end refund claims.

Note: Withholding tax is a prepayment, not a reduction in the actual tax owed. Income earners still file their annual returns and calculate their tax as usual.

5. Impact and Benefits for Businesses

  •     Better liquidity. The Ministry of Finance estimates about THB 27 billion a year in additional private-sector cash flow.
  •     Less paperwork. The bank withholds and remits the tax and issues electronic evidence, so the payer does not need to file PND 3/53 or issue a 50 Tawi certificate for payments made through e-WHT.
  •     A 200% deduction (under Royal Decree No. 808) for investment in e-Tax Invoice & e-Receipt and e-WHT systems, and for fees paid to service providers, such as data preparation and transmission, electronic certificates and data storage.
  •     New for service providers: a 200% deduction for information-system assessment fees paid to ETDA.
  •     As payees, businesses receive fuller and faster payment from customers.

6. Contract Points Businesses Should Consider

  •     Pricing: State clearly whether prices are gross or net of WHT, especially in gross-up arrangements, because a different rate changes the cost.
  •     Payment method: Add a clause requiring payment through e-WHT, and set out each party’s duty to provide accurate details such as tax ID, branch and bank account.
  •     Bank fees: Agree on which party bears them.
  •     Tax evidence: Replace clauses that require delivery of a paper 50 Tawi certificate with electronic evidence.
  •     Liability: Set out liability and indemnities for withholding under the wrong income type or at the wrong rate.

7. Tax Compliance Points

  •     Select the correct income type every time you pay through e-WHT. If you choose the wrong type or under-withhold, the payer becomes jointly liable for the tax under Section 54 and owes a surcharge of 1.5% per month under Section 27.
  •     Check that the payee is not a foundation or association and is not located abroad.
  •     For payments made in early 2026 before the Ministerial Regulation took effect, if tax was already withheld at the standard rate, the payee can credit it in their annual return. Seek advice on any unusual cases.
  •     Reconcile your accounts against the data the bank submits, and keep the electronic evidence ready for audit.
  •     To claim the 200% deduction, meet every condition: assets must be new, located in Thailand and used for at least three accounting periods, and must not already receive other tax incentives such as BOI privileges.
