กองทุนสงเคราะห์ลูกจ้างตามพระราชบัญญัติคุ้มครองแรงงาน พ.ศ. 2541 เริ่มจัดเก็บเงินสะสมและเงินสมทบตั้งแต่วันที่ 1 ตุลาคม 2569
หลังจากมีการเลื่อนกำหนดเวลามาแล้วครั้งหนึ่ง กองทุนสงเคราะห์ลูกจ้างได้เริ่มจัดเก็บเงินสะสมจากลูกจ้างและเงินสมทบจากนายจ้างอย่างเป็นทางการตั้งแต่วันที่ 1 ตุลาคม 2569 เป็นต้นไป ถือเป็นการเปลี่ยนแปลงครั้งสำคัญของระบบหลักประกันทางการเงินของลูกจ้างไทย และเป็นภาระหน้าที่ใหม่ที่นายจ้างจำนวนมากต้องปฏิบัติตาม
กองทุนสงเคราะห์ลูกจ้างคืออะไร
กองทุนสงเคราะห์ลูกจ้างเป็นกองทุนที่จัดตั้งขึ้นตามหมวด 13 แห่งพระราชบัญญัติคุ้มครองแรงงาน พ.ศ. 2541 โดยมีวัตถุประสงค์เพื่อเป็นหลักประกันทางการเงินให้แก่ลูกจ้างเมื่อสิ้นสุดการเป็นลูกจ้างหรือเสียชีวิต แนวคิดคล้ายกับกองทุนสำรองเลี้ยงชีพ แต่เป็นกลไกภาคบังคับตามกฎหมายสำหรับสถานประกอบกิจการที่ยังไม่มีสวัสดิการในลักษณะดังกล่าว โดยอัตราเงินสะสมและเงินสมทบกำหนดไว้ในกฎกระทรวงซึ่งมีผลใช้บังคับตั้งแต่วันที่ 1 ตุลาคม 2569
ใครต้องเข้ากองทุน และใครได้รับยกเว้น
นายจ้างที่มีลูกจ้างตั้งแต่ 10 คนขึ้นไป มีหน้าที่ต้องขึ้นทะเบียนและนำส่งเงินเข้ากองทุน อย่างไรก็ตาม นายจ้างที่ได้จัดให้มีกองทุนสำรองเลี้ยงชีพหรือสวัสดิการอื่นที่มีลักษณะเทียบเท่าตามหลักเกณฑ์ที่กฎหมายกำหนดไว้แล้ว จะได้รับยกเว้นไม่ต้องเข้ากองทุนนี้ ส่วนสถานประกอบกิจการที่มีลูกจ้างน้อยกว่า 10 คน ยังไม่อยู่ในบังคับ แต่สามารถสมัครเข้าร่วมโดยความสมัครใจได้ นอกจากนี้ กฎหมายยังกำหนดข้อยกเว้นสำหรับกิจการบางประเภทและบุคคลบางกลุ่มไว้เป็นการเฉพาะ จึงควรตรวจสอบสถานะของกิจการให้ชัดเจน
อัตราเงินสะสมและเงินสมทบ
ในช่วงตั้งแต่วันที่ 1 ตุลาคม 2569 ถึงวันที่ 30 กันยายน 2574 ลูกจ้างจ่ายเงินสะสมในอัตราร้อยละ 0.25 ของค่าจ้าง และนายจ้างจ่ายเงินสมทบในอัตราเดียวกันคือร้อยละ 0.25 ของค่าจ้าง จากนั้นตั้งแต่วันที่ 1 ตุลาคม 2574 เป็นต้นไป อัตราจะปรับเพิ่มเป็นฝ่ายละร้อยละ 0.50 ของค่าจ้าง
ตัวอย่างเช่น ลูกจ้างที่ได้รับค่าจ้างเดือนละ 12,000 บาท จะถูกหักเงินสะสมเดือนละ 30 บาท และนายจ้างจ่ายสมทบอีก 30 บาท รวมเป็นเงินเข้ากองทุนในนามของลูกจ้างรายนั้นเดือนละ 60 บาท ซึ่งถือเป็นภาระที่ไม่สูงนักเมื่อเทียบกับประโยชน์ที่ลูกจ้างจะได้รับในระยะยาว
หน้าที่ของนายจ้างที่ต้องดำเนินการ
นายจ้างที่อยู่ในบังคับต้องขึ้นทะเบียนนายจ้างและขึ้นทะเบียนลูกจ้างต่อกรมสวัสดิการและคุ้มครองแรงงาน ซึ่งปัจจุบันดำเนินการผ่านระบบ e-Service พร้อมทั้งจัดให้ลูกจ้างแจ้งชื่อผู้รับประโยชน์ไว้ล่วงหน้า จากนั้นต้องหักเงินสะสมจากค่าจ้างของลูกจ้างในแต่ละงวด และนำส่งเงินสะสมพร้อมเงินสมทบเข้ากองทุนภายในวันที่ 15 ของเดือนถัดไป กล่าวคือ ค่าจ้างของเดือนตุลาคม 2569 ต้องนำส่งภายในวันที่ 15 พฤศจิกายน 2569 นอกจากนี้ยังมีหน้าที่แจ้งการเปลี่ยนแปลงข้อมูลลูกจ้างเมื่อมีการรับเข้าหรือพ้นสภาพภายในกำหนดเวลาที่กฎหมายกำหนด
ลูกจ้างได้อะไร
เมื่อสิ้นสุดการเป็นลูกจ้างไม่ว่าด้วยเหตุใด ไม่ว่าจะเป็นการลาออกโดยสมัครใจ การถูกเลิกจ้าง หรือการเกษียณอายุ ลูกจ้างมีสิทธิได้รับเงินสะสมที่ตนจ่ายไป เงินสมทบที่นายจ้างจ่ายให้ และดอกผลที่เกิดขึ้น คืนเป็นเงินก้อนตามระยะเวลาที่กฎหมายกำหนด และในกรณีที่ลูกจ้างเสียชีวิต เงินจำนวนดังกล่าวจะจ่ายให้แก่ผู้รับประโยชน์ที่ได้ระบุไว้ จุดเด่นสำคัญคือสิทธินี้ไม่ผูกกับเหตุแห่งการเลิกจ้าง ลูกจ้างจึงได้รับเงินคืนแม้จะลาออกเอง ซึ่งแตกต่างจากค่าชดเชยตามกฎหมายคุ้มครองแรงงานที่จ่ายเฉพาะกรณีถูกเลิกจ้างโดยไม่มีความผิด
นายจ้างได้อะไร
แม้กองทุนนี้จะเพิ่มต้นทุนแรงงานให้แก่นายจ้าง แต่ในอัตราร้อยละ 0.25 ของค่าจ้างถือว่าอยู่ในระดับที่บริหารจัดการได้ ขณะเดียวกันยังช่วยยกระดับสวัสดิการขององค์กรโดยไม่ต้องจัดตั้งกองทุนสำรองเลี้ยงชีพซึ่งมีต้นทุนและภาระการบริหารสูงกว่า อีกทั้งยังเป็นปัจจัยที่ช่วยเสริมภาพลักษณ์ในการดึงดูดและรักษาบุคลากร นอกจากนี้ ในบางกรณีกองทุนยังทำหน้าที่เป็นกลไกรองรับเมื่อนายจ้างไม่สามารถจ่ายค่าชดเชยหรือเงินอื่นตามกฎหมายได้ ซึ่งช่วยลดความเสี่ยงของข้อพิพาทแรงงานในทางปฏิบัติ
บทลงโทษหากไม่ปฏิบัติตาม
นายจ้างที่ไม่นำส่งเงินสะสมและเงินสมทบภายในกำหนด หรือนำส่งไม่ครบถ้วน ต้องจ่ายเงินเพิ่มในอัตราร้อยละ 5 ต่อเดือนของจำนวนเงินที่ค้างชำระ และหากยังคงเพิกเฉยหลังได้รับคำเตือนจากพนักงานตรวจแรงงาน อาจถูกดำเนินคดีตามกฎหมายซึ่งมีทั้งโทษปรับและโทษจำคุกตามที่พระราชบัญญัติคุ้มครองแรงงานกำหนด นายจ้างจึงไม่ควรละเลยกำหนดเวลานำส่งในแต่ละเดือน
สิ่งที่ควรเตรียมพร้อม
นายจ้างควรตรวจสอบก่อนเป็นลำดับแรกว่ากิจการของตนอยู่ในบังคับหรือได้รับยกเว้น โดยเฉพาะกรณีที่มีกองทุนสำรองเลี้ยงชีพอยู่แล้วแต่ครอบคลุมลูกจ้างเพียงบางกลุ่ม ซึ่งอาจยังมีหน้าที่สำหรับลูกจ้างส่วนที่เหลือ จากนั้นควรปรับปรุงระบบเงินเดือนให้รองรับการหักเงินสะสมและการออกรายงานนำส่ง ทบทวนข้อบังคับเกี่ยวกับการทำงานและเอกสารการจ้างให้สอดคล้องกับหน้าที่ใหม่ ตลอดจนสื่อสารกับลูกจ้างให้เข้าใจถึงรายการหักเงินที่จะปรากฏในสลิปเงินเดือนและสิทธิที่จะได้รับ เพื่อป้องกันความเข้าใจผิดและข้อร้องเรียนที่อาจตามมา

Employee Welfare Fund Contributions Have Begun: What Employers and Employees Gain
The Employee Welfare Fund under the Labour Protection Act B.E. 2541 began collecting savings and contributions on 1 October 2569 (2026)
Following an earlier postponement, the Employee Welfare Fund has now formally begun collecting savings from employees and matching contributions from employers with effect from 1 October 2569 (2026). This marks a significant development in the financial safety net available to workers in Thailand, and a new statutory obligation for a large number of employers.
What Is the Employee Welfare Fund
The Employee Welfare Fund is established under Chapter 13 of the Labour Protection Act B.E. 2541 to provide employees with financial security upon the end of their employment or upon death. It is similar in concept to a provident fund, but operates as a mandatory statutory mechanism for workplaces that do not already offer an equivalent benefit. The applicable savings and contribution rates are prescribed by ministerial regulation, effective from 1 October 2569 (2026).
Who Must Join and Who Is Exempt
Employers with 10 or more employees are required to register and remit contributions to the Fund. Employers that already maintain a provident fund or another benefit scheme meeting the equivalence criteria prescribed by law are exempt. Workplaces with fewer than 10 employees are not yet within scope but may join voluntarily. The law also provides specific exemptions for certain categories of business and certain groups of individuals, so each employer should confirm its own position carefully.
Savings and Contribution Rates
From 1 October 2569 (2026) to 30 September 2574 (2031), employees contribute savings at 0.25 percent of wages and employers contribute a matching 0.25 percent of wages. From 1 October 2574 (2031) onwards, the rate increased to 0.50 percent for each party.
By way of illustration, an employee earning THB 12,000 per month will have THB 30 deducted as savings, with the employer contributing a further THB 30, giving a total of THB 60 paid into the Fund in that employee name each month. The burden is modest relative to the long-term benefit to the employee.
What Employers Must Do
Employers within scope must register themselves and their employees with the Department of Labour Protection and Welfare, currently through the Department e-Service system, and arrange for employees to nominate beneficiaries in advance. Employers must then deduct the savings amount from wages each pay period and remit both the savings and the employer contribution to the Fund by the 15th day of the following month. Wages for October 2569 (2026), for example, must be remitted by 15 November 2569 (2026). Employers must also report changes in their workforce, whether new hires or departures, within the periods prescribed by law.
What Employees Gain
When employment ends for any reason, whether by voluntary resignation, termination, or retirement, the employee is entitled to receive back their own savings, the employer contributions, and any accrued returns, paid as a lump sum within the period prescribed by law. Where an employee dies, the amount is paid to the nominated beneficiary. Importantly, this entitlement does not depend on the reason for separation, so an employee who resigns voluntarily still receives the money. This distinguishes it from statutory severance pay, which is payable only where an employee is dismissed without cause attributable to them.
What Employers Gain
While the Fund adds to labour costs, a rate of 0.25 percent of wages remains manageable. It also raises the standard of welfare offered by the organisation without the cost and administrative burden of establishing a provident fund, and supports the employer position in attracting and retaining staff. In certain circumstances the Fund also serves as a backstop where an employer is unable to pay severance or other statutory amounts, which in practice helps reduce the risk of labour disputes.
Penalties for Non-Compliance
An employer that fails to remit savings and contributions on time, or remits an incomplete amount, must pay a surcharge of 5 percent per month on the outstanding sum. Where the employer continues to disregard the obligation after a warning from a labour inspector, it may face prosecution, with fines and imprisonment as provided under the Labour Protection Act. The monthly remittance deadline should therefore not be treated lightly.
Preparing for Compliance
Employers should first confirm whether they fall within scope or qualify for an exemption, paying particular attention to cases where a provident fund exists but covers only part of the workforce, as obligations may remain for the remainder. Payroll systems should then be updated to handle the deduction and the required remittance reporting; work rules and employment documentation should be reviewed for consistency with the new obligation; and employees should be briefed on the new deduction appearing on their payslips and the entitlement it gives them, so as to avoid misunderstanding and complaints.
