Not Required in Every Case, but Wise Almost Every Time
First, understand that the law does not require a demand letter for every debt; some claims can be filed immediately. But in practice, sending one first brings real benefits, both legal and tactical. Here are the four main reasons.
Reason 1: It Puts the Debtor “in Default” so You Can Claim Interest and Damages
Under Civil and Commercial Code Section 204, if a debt has no fixed calendar due date, the debtor falls into “default” only after the creditor has given a warning and the debtor still fails to pay.
A demand letter is precisely that legal “warning.” Once the debtor is in default, the creditor can claim default interest and related damages from the date of default.
